By sending a message to and interacting with the IncogTalk bot (@incogtalk) on Instagram ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Age Requirement

You must be at least 18 years of age to use the Service. By using IncogTalk, you confirm that you meet this age requirement. We do not knowingly engage with users under the age of 18.

3. User Conduct and Responsibilities

You are solely responsible for your conduct and any content you transmit while using the Service. By using IncogTalk, you agree not to engage in any of the following prohibited activities:

• Harassment, bullying, abuse, hate speech, or threats against other users.

• Sharing nudity, or any sexually explicit or pornographic content.
• Sharing illegal content, including but not limited to content related to drugs, violence, or other criminal acts.
• Impersonating someone else or misrepresenting your affiliation with any person or entity.
• Anything unlawful, misleading, fraudulent, or for an illegal or unauthorized purpose.
• Attempting to exploit, hack, disrupt, or reverse-engineer the Service or its underlying systems.

You are responsible for your own actions and the content you send through the Service. You acknowledge that voluntarily sharing personal information is done at your own risk. We are not responsible for any consequences arising from your interactions or the information you decide to share.

4. Enforcement and Termination

We reserve the right to enforce these Terms at our sole discretion. Depending on the severity of the violation and a user's violation history, consequences for violating these rules may include a warning, a temporary suspension, or a permanent ban from the Service. Users can be reported at any time using the /report command.

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, with or without notice, including but not limited to a breach of these Terms.

5. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will be uninterrupted, timely, secure, or error-free. You use the Service at your own risk. We are not responsible for the content, conduct, or actions of users on the platform. We expressly disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

6. Limitation of Liability

To the fullest extent permitted by applicable law, We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any emotional or financial damages resulting from (a) your access to, use of, or inability to access or use the Service; (b) any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive, or illegal conduct of other users; or (c) actions of third parties.

7. Reliance on Third-Party Platforms

The Service is entirely dependent on the Instagram platform, operated by Meta Platforms, Inc. We are not responsible for any service interruptions, changes, or termination of service resulting from actions taken by Meta. Your use of the Service is also subject to Instagram's Terms of Use.

8. Premium Services

We reserve the right to offer additional features or functionalities as part of a premium, paid service in the future. The use of such premium services will be subject to separate payment terms, which will be presented to you before you commit to any purchase.

9. Indemnification

You agree to indemnify, defend, and hold harmless IncogTalk, its creator, affiliates, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of another user or third party.

10. No Emergency Use

The Service is not designed or intended for use in emergencies. Do not rely on IncogTalk for urgent or life-threatening situations. If you are in danger or require immediate assistance, contact your local authorities or emergency services.

11. Intellectual Property

All rights, title, and interest in and to the Service, including but not limited to the name “IncogTalk,” logos, design elements, software, and other intellectual property, are and shall remain the exclusive property of the creator of IncogTalk. You are granted a limited, non-exclusive, revocable license to use the Service in accordance with these Terms.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue in full force and effect.

13. Changes to Terms

We may modify these Terms from time to time. We will notify you of any significant changes by sending a message via the IncogTalk bot (if not limited by instagram api) and/or updating the "Last Updated" date on this page. We also reserve the right to make updates at our discretion without prior notice, and we encourage you to review this page periodically to stay informed about the Terms of Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Rajasthan, India.
